General Conditions of sale
Please read this Agreement attentively.

GENERAL CONDITIONS OF SALE

The on-line publishing, the publication and the management of ads present on this web site WWW.NAUTICADS.COM are managed by the company ALL BUSINESS AVENUE located in France, 1 place du Chardonnet - 37000 TOURS, RCS 510 110 620.
The present general conditions of sale have for object to define the modalities in which the ALL BUSINESS AVENUE company gives to the Internet user a paying service of deposit of visible ads on its site and the modalities in which the ALL BUSINESS AVENUE company, as broker, puts in relationship the Internet users to allow them to realize the purchase or the sale against payment.

Article 1 : Acceptance of the general conditions of sale
The service is proposed to the Internet user subject to its acceptance of the general conditions of sale. As a consequence, the Internet user confirms have acquainted with the present general conditions of sale and marks the compartment " I accept the general conditions of sales " before proceeding to the payment of its ads.
In case of non compliance by the Internet user of the present general conditions, NAUTICADS.COM reserves the right to refuse him (her) the access to the deposit of ads.

Article 2 : Description of the service
ALL BOATS AVENUE.COM proposes ads of purchase, sale or rent of boats (new, secondhand goods, …) of equipment, material and services connected to the water sport (place of port, wintering, repair, maintenance)
The advertiser deposits and confirms an ad by the seizure of a form.
The accepted payment conditions are banking or mail checks, bank cards according to a secure mode. (PayPal, …)

Article 3 : Deposit and management of the ad
The publication of the ad is limited to a period of x month as from the date of the seizure of the ad, and according to the chosen fixed price (package).
Once the on-line ad, the Internet user will regularly have to confirm that his good or his service is very available on the sale. The Internet user will be warned by e-mail of the nearness of the expiration of his (her) ad and, in that case, he (she) will have the possibility of prolonging the publication of his (her) ad, according to the current price list. If the ad was not renewed, it will not be any more shown.
These conditions aim at proposing a database of really available goods or services.
The avetisers make a commitment to warn NAUTICADS.COM as soon as the transaction was realized in purposes of deletion of the ad.
The ad is taken into account since the payment was made.
When the ad was seized and paid, the Internet user benefits from no right  of shrinkage according to the article L 121-20 of the code of the consumption.
NAUTICADS.COM reserves the right not to diffuse an illegible and overloaded document or of very bad quality.
Photos and videos can be possibly used to illustrate promotional documents.

Article 4 : Payment
The price applicable to every deposit of ad is the one current in the date of the deposit such as mentioned on the site.
The shown prices get TTC for the private individuals and HT for the professionals. *****
The accepted payment conditions are banking or mail checks and bank cards according to a secure mode.
A complete payment is required before the publication on the site.
The incomplete payments by check will not be taken.
The check will be sent back to the advertiser or destroyed with his (or her) written agreement.

Article 5 : Commitment of the user
The advertiser certifies on the honor the exactness of the information communicated in his (her) ad, he confirms that he is the unique and exclusive author of the ad; as such he(her) takes the whole responsibility of the contents of the ad to be deposited.
By depositing the ad, the advertiser makes a commitment in :
· Be an owner of the good or the service, or appointed for the sale of the good or the advertised service
· If necessary, having an inspection
 ·To propose the good or the service free of security
The Internet user also commits to the fact that his (her) ad breaks no law and regulation (including in particular those governing the control of the exports, the protection of the consumers, the unfair competition, the discriminatory practices or the misleading advertising) and guarantees that he is a holder of the intellectual rights on either on-line publishing photos or videos with the ad and that they are the faithful reproduction of the advertised good.

Article 6 : Responsability
The advertiser certifies on the honor the exactness of the information communicated in his (her) ad, he acknowledges that he is the exclusive and unique author of the ad, as such he takes the whole responsibility of the contents of the ad for which he asks to be published.
NAUTICADS.COM does not control the general state of the good or the service put in the sale, neither the correspondence with the description, neither the safety of the good or the service, intervenes nor in the conclusion of the possible sale contract, nor in the delivery or the payment of the price, thus in case of dispute between the salesman and the buyer, NAUTICADS.COMcannot be considered responsible for any current or future damage.
NAUTICADS.COM reserves the right to remove an ad purely and simply, when its nature, its text, or its presentation would appear as against the moral and commercial interests of NAUTICADS.COM without the other obligation than the refund (repayment) of the engaged sum.

Article 7 : Limitation of responsability
NAUTICADS.COM gets free of any responsibility as for the exactness or the relevance of the contents of ads.
The responsibility of ALL BOATS AVENUE.COM is limited in every case to the price of the service.
NAUTICADS.COM has only an obligation of means.

Article 8 : Personal datas
According to the law n°78-17 of January 06th, 1978, said "computing and freedom ", the information registered by NAUTICADS.COMwas the object of a declaration with the French National Commission of the Computing and of the Liberties - CNIL - N° 1372295.
According to the article 27 of the law n°78-17 of January 06th, 1978, you arrange at any time a right of access and rectification of your personal datas.

Article 9 : Cookies
The advertiser is informed that NAUTICADS.COM is entitled to use cookies in the exclusive part of the smooth running of the services proposed on the site.
Any cookies placed by NAUTICADS.COM can be deleted at once from your Internet browser.

Article 10 : Field of application
The professional advertisers are subjected to the present general conditions and to the particular conditions appearing on the contract.

Article 11 : Modification of the general conditions of sale
The NAUTICADS.COM company reserves the right to modify the general conditions of sale.
The customers who would not wish that the contractual relations are governed by the new version of the general conditions of sale, will have to notify it and, as from the date from which the new version will come into effect, they will have to stop using the NAUTICADS.COM services.
In the hypothesis one some of the terms of the general conditions of sale would be considered as illegal or non-opposable by a decision of justice, the other conditions will be in force.
